1. Agreement Acceptance and Definitions

1.1 Binding Agreement

2.2 Account Registration Process

During registration, Players must provide accurate, current, and complete information including but not limited to:

• Full legal name as it appears on government-issued identification;
• Valid date of birth;
• Current residential address in the Philippines;
• Valid email address and mobile phone number;
• Secure password meeting minimum security requirements.

Players warrant that all information provided during registration and thereafter is truthful, accurate, current, and complete. Any false, misleading, or fraudulent information constitutes a material breach of this Agreement and may result in immediate Account suspension, termination, and forfeiture of all funds.

2.3 Single Account Policy

Each Player is permitted to maintain only one (1) Account with phe365. The creation of multiple Accounts, whether using different personal information, payment methods, or devices, is strictly prohibited and constitutes fraud. phe365 employs sophisticated detection systems to identify duplicate Accounts. Discovery of multiple Accounts will result in closure of all duplicate Accounts, forfeiture of balances and bonuses, and potential legal action.

2.4 Account Security

Players are solely responsible for maintaining the confidentiality and security of their Account credentials, including username and password. Players must immediately notify phe365 of any unauthorized access, security breach, or suspected fraudulent activity. phe365 is not liable for any losses, damages, or unauthorized transactions resulting from Player failure to maintain Account security, except in cases of proven platform security failures.

3. Financial Transactions

3.1 Deposits

phe365 accepts deposits via approved payment methods including GCash, Maya, Philippine bank transfers (BPI, BDO, Metrobank, UnionBank), InstaPay, PesoNet, and cryptocurrency (Bitcoin, USDT). Minimum and maximum deposit limits are displayed on the Platform and may vary by payment method. All deposits are subject to:

• Identity verification requirements under Philippine anti-money laundering laws;
• Source of funds verification for deposits exceeding PHP 50,000 or equivalent;
• Processing times varying by payment method (instant for GCash/Maya, 1-3 business days for bank transfers);
• Potential third-party payment processor fees disclosed prior to transaction completion.

Deposits are credited to the Player Account upon verification and processing. phe365 reserves the right to refuse or reverse any deposit if fraud, money laundering, or violation of these Terms is suspected.

3.2 Withdrawals

Players may withdraw available Account balance (excluding bonus funds subject to wagering requirements) by requesting a withdrawal through their Account dashboard. Withdrawal requests are subject to:

• Minimum withdrawal amount of PHP 500 or equivalent;
• Mandatory identity verification (KYC) prior to first withdrawal, requiring submission of government-issued ID and proof of address;

phe365 processes withdrawals as expeditiously as possible but cannot guarantee specific timeframes due to third-party payment processor constraints and compliance requirements.

3.3 Anti-Money Laundering Compliance

phe365 maintains strict anti-money laundering (AML) and counter-terrorism financing policies in compliance with Philippine law. Players agree to:

• Provide source of funds documentation when requested;
• Submit to enhanced due diligence for high-value transactions;
• Acknowledge that deposits must be wagered at least one (1) time before withdrawal (to prevent use of phe365 as a money transfer service);
• Accept that suspicious transactions may be reported to PAGCOR and Philippine regulatory authorities.

3.4 Currency and Conversion

The primary currency for phe365 operations is Philippine Peso (PHP). Deposits and withdrawals in foreign currencies or cryptocurrency are converted to PHP at prevailing market rates plus applicable conversion fees. Players accept exchange rate risk associated with currency conversions.

4. Gaming Rules and Conduct

All Players must engage with phe365 Services in good faith and in accordance with fair gaming principles. The following activities are strictly prohibited and constitute material breach of this Agreement:

• Collusion: Coordinating with other Players to gain unfair advantage in multiplayer games or tournaments;
• Bonus Abuse: Exploiting bonuses through multiple Accounts, coordinated betting patterns, or violation of bonus terms;
• Fraudulent Betting: Exploiting technical errors, game malfunctions, or delayed results for profit;
• Use of Automated Systems: Employing bots, scripts, or automated betting systems to place wagers;
• Arbitrage Betting: Exploiting odds discrepancies across platforms for guaranteed profit;
• Chip Dumping: Deliberately losing to transfer funds to other Players;
• Account Sharing: Allowing third parties to access or use your Account;
• Payment Fraud: Using stolen payment methods, conducting chargebacks, or engaging in payment fraud.

Discovery of prohibited activity will result in immediate Account suspension, forfeiture of all balances and winnings, and potential legal action. phe365 may report fraudulent activity to law enforcement authorities.

4.2 Game Integrity

All Games offered on the phe365 Platform utilize certified Random Number Generators (RNG) audited by independent testing agencies. Game outcomes are determined by RNG and cannot be predicted, manipulated, or influenced by phe365 or Players. Return-to-Player (RTP) percentages are published for each Game and represent long-term statistical averages, not guarantees of individual session results.

4.3 Technical Malfunctions

In the event of technical malfunction, system error, game defect, or software bug affecting Game outcomes:

• All affected wagers and payouts are void;
• phe365 will conduct investigation and make final determination on appropriate resolution;

• phe365 liability is limited to return of affected wager amounts.

4.4 Responsible Gaming Obligations

• Utilize self-exclusion tools if experiencing gambling-related problems;
• Never gamble with funds needed for essential expenses;
• Seek help from problem gambling support services if needed;
• Understand that gambling should be entertainment, not income generation.

Players may request temporary or permanent self-exclusion by contacting phe365 support. Self-exclusion requests are processed immediately and cannot be reversed during the exclusion period.

5. Bonuses and Promotions

Unauthorized use of phe365 intellectual property constitutes infringement and may result in legal action.

7. Privacy and Data Protection

phe365 collects, processes, and stores Player personal information in accordance with our Privacy Policy and the Philippine Data Privacy Act of 2012. By accepting these Terms, Players consent to:

• Collection of personal information necessary for Account registration and operation;
• Processing of gaming activity, transaction history, and behavioral data;
• Sharing of information with payment processors, game providers, and regulatory authorities as required;
• Use of cookies and tracking technologies to enhance Platform functionality;
• Storage of data on secure servers located in the Philippines and approved jurisdictions;
• Retention of Account data for regulatory compliance periods (typically 7 years post-closure).

8. Limitation of Liability and Disclaimers

8.2 Disclaimer of Warranties

THE phe365 PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. phe365 DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, AND NON-INFRINGEMENT. phe365 DOES NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR MALICIOUS CODE.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW, phe365 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. phe365'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT OF DEPOSITS MADE BY THE PLAYER IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

8.4 Indemnification

Players agree to indemnify, defend, and hold harmless phe365, its officers, directors, employees, affiliates, and licensors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from Player violation of these Terms, breach of warranties, infringement of third-party rights, or misuse of the Platform.

9. Dispute Resolution and Governing Law

9.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from or relating to this Agreement or use of phe365 Services shall be subject to the exclusive jurisdiction of Philippine courts.

9.2 Dispute Resolution Process

In the event of any dispute, Players agree to first attempt informal resolution by contacting phe365 customer support with a detailed description of the issue. phe365 will investigate and respond within reasonable timeframes (typically 7-14 business days for complex matters).

If informal resolution fails, disputes may be escalated to PAGCOR's dispute resolution mechanisms as appropriate for regulated gaming matters. For contractual disputes not within PAGCOR's purview, parties may pursue arbitration or litigation in Philippine courts.

9.3 Class Action Waiver

Players agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration against phe365.

10. Account Closure and Termination

10.1 Voluntary Closure

Players may request Account closure at any time by contacting customer support. Upon closure request:

• All pending wagers must be settled;
• Withdrawal of remaining Account balance must be processed;
• Active bonuses will be forfeited;
• Personal data will be retained per regulatory requirements;
• Closure may take up to 48 hours to process completely.

10.2 Involuntary Termination

phe365 reserves the right to suspend or terminate any Account immediately without prior notice if:

• Player violates these Terms and Conditions;
• Fraudulent, abusive, or illegal activity is detected;
• Player provides false or misleading information;
• Multiple Accounts are identified;
• Player is found to be underage or legally prohibited from gaming;
• Account inactivity exceeds 24 months;
• Required verification documents are not provided when requested.

Upon involuntary termination, phe365 may forfeit Account balances and winnings if termination results from Player breach of Terms. Legitimate deposits will be refunded after deduction of applicable fees and investigation costs.

11. Miscellaneous Provisions

11.1 Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Responsible Gaming Policy, and specific game rules, constitute the entire agreement between Player and phe365, superseding all prior agreements, representations, and understandings.

11.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.

11.3 Waiver

Failure by phe365 to enforce any provision of these Terms does not constitute waiver of that provision or any other provision. No waiver shall be effective unless made in writing and signed by authorized phe365 representatives.

11.4 Assignment

Players may not assign, transfer, or delegate their rights or obligations under these Terms without prior written consent from phe365. phe365 may freely assign this Agreement to affiliates, successors, or purchasers of the business.

11.5 Language

These Terms are provided in English. In the event of translation into other languages, the English version shall prevail in case of any discrepancy or dispute.
